These Terms are governed by the laws of the United States and of the state in which GREEN MOTION GROUNDSKEEPERS LLC is registered and delivers its services. Any dispute arising from these Terms or from services provided will be resolved in the state and federal courts of that jurisdiction, unless a different forum is required by applicable consumer protection law.

By accessing and using this website (the "Site"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree with these Terms, please do not use the Site.

You agree to use this Site only for lawful purposes and in a way that does not infringe on the rights of others or restrict their use and enjoyment of the Site. You may not attempt to gain unauthorized access to the Site, related accounts or systems, nor interfere with the normal operation of the Site.

4. Services and scope

This Site does not constitute an offer to provide services. Every engagement is finalized by way of a written estimate issued in advance and accepted by the client — describing scope of work, areas covered, service frequency (for recurring maintenance contracts), crew size, timeline, price, payment terms, cancellation policy and the parties' respective obligations —, and services are invoiced per the terms of that estimate or contract. GREEN MOTION GROUNDSKEEPERS LLC operates under NAICS 561730 — Landscaping Services, holding state and local business licenses in force in the jurisdictions where we operate, state pesticide applicator credentials held by our certified applicator(s), and where required by the state a state landscape contractor license or state irrigation contractor license. WE ARE NOT landscape architects (NAICS 541320) — stamped landscape architectural design requiring the seal of a state-licensed landscape architect is referred to licensed landscape architects separately engaged by the client; WE ARE NOT consulting arborists (NAICS 541690) — arboricultural consultation, tree risk assessments and expert-witness services are referred to ISA Certified or Consulting Arborists; WE ARE NOT utility line clearance contractors — tree work in proximity to energized high-voltage utility lines requires specialty training and utility contracts; WE ARE NOT a structural pest control company — termite, wood-destroying organism and building interior pest treatment is a distinct regulated activity (California Structural Pest Control Board, Texas Structural Pest Control Service, and equivalents) and is referred to licensed structural pest control operators; WE ARE NOT a fence installation company as a primary activity (NAICS 238990); WE ARE NOT a general contractor and do not perform work requiring a general contractor's license — major hardscape, retaining walls above locally regulated heights, pools, decks and other work requiring a state GC or specialty contractor license is referred to licensed contractors; WE ARE NOT a pool builder or pool service company — pool construction and pool service require separate state pool contractor and pool service licenses in most states; WE ARE NOT an excavation and site preparation contractor (NAICS 238910) — major grading and excavation are performed by licensed excavation contractors; WE ARE NOT a nursery or garden center (NAICS 444220) — we do not operate a retail nursery; WE ARE NOT a licensed electrician — landscape lighting installed by our crews is limited to low-voltage systems; any line-voltage electrical work is referred to state-licensed electricians; WE ARE NOT a licensed plumber — connections of irrigation systems to potable water supplies observe applicable backflow-prevention requirements and, where required by local code, are inspected or performed by licensed plumbers; WE ARE NOT a snow removal contractor for municipal contracts; WE ARE NOT a waste hauler (NAICS 562119) — green waste is disposed of through licensed waste management providers; and WE ARE NOT a legal, accounting, insurance or financial services provider. For any of the above, we refer clients to appropriately licensed professionals or firms of their choosing. Our operations are conducted in compliance with applicable US laws and industry standards, including OSHA workplace safety standards for landscaping and horticultural services, EPA Worker Protection Standard (WPS) for pesticide application, state pesticide applicator licensing, state landscape contractor and irrigation contractor licensing where required, state and local business licensing, state stormwater and water-conservation regulations where applicable, local noise ordinances for equipment operation, DOT commercial vehicle regulations for trucks and trailers above applicable weight thresholds, general liability insurance and workers compensation insurance maintained in force, and applicable federal and state truthful advertising standards enforced by the FTC and state attorneys general.

5. Confidentiality and data

In the course of providing services, we may collect and process information related to the client's cadastre, service address, site access routines (schedules, keys, alarm codes, gate access), preferences (approved products, restricted areas, presence of pets or children when voluntarily disclosed) and service invoicing documentation. Such information is handled under our Privacy Policy and applicable US privacy laws, including the California Consumer Privacy Act (CCPA/CPRA) where applicable, and is treated as confidential and accessed only as necessary to perform the services under contract.

6. Disclaimer of warranties

The Site and its content are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, regarding the Site itself. Warranties relating to the services delivered are governed by the specific terms of the estimate or contract executed with each client. We do not make specific outcome promises beyond the agreed scope — landscape results depend on factors outside our operational control (weather, drought conditions and local water restrictions, soil conditions, pre-existing plant health, wildlife and pest pressure, HOA and municipal restrictions, and the client's adherence to recommended watering and care between service visits); plant warranties, where offered as part of an installation project, are limited to the terms stated in the applicable estimate or contract and require compliance with the recommended aftercare. Any statutory consumer protection rights that apply to our services are not affected by this disclaimer.

7. Changes to these terms

To the fullest extent permitted by law, GREEN MOTION GROUNDSKEEPERS LLC shall not be liable for indirect or consequential damages arising from use of this Site. Liability arising from the provision of services is governed by the specific terms of the estimate or contract executed with each client and by applicable federal and state consumer protection laws — including the right to redress for defective service, timely completion within the agreed scope, and truthful disclosure of service characteristics as required by the FTC and state consumer protection statutes.
